Work authorization
In order to work in the United States, all U.S. employers are required to make sure that all of their employees are eligible to work, including United States citizens.
If you are not a United States citizen, there are a number of ways in which you may be permitted to legally reside and work in the United States. If you fall into one of the following categories of people, you are permitted to work legally in the United States: you have authorization to work in the United States as a result of your nonimmigrant status; you have authorization to work for a specific employer as a result of your nonimmigrant status; or you are in a category which requires you to file for permission to work. If you fall into the first or the third category, you are required to apply for work authorization, which entails applying for an Employment Authorization Document (EAD) via form I-765, Application for Employment Authorization. You must do this before you will be permitted to work and you must also do this before you are permitted to look for work in the United States. If you are a United States citizen, a lawful permanent resident, or a conditional permanent resident, you are not required to apply for and obtain an EAD prior to seeking and obtaining work in the United States. USCIS will issue EADs for a few reasons. First, they will issue an work authorization as evidence that you are permitted to work in the United States for a specific period of time. Second, they will issue an EAD in order to renew an expired EAD. Third, they will issue an work permit to replace an EAD. If your EAD has expired but you are still eligible for work authorization, you will need to file for a renewal of your work permit. To get your EAD renewed, you must file form I-765. You are not permitted to apply for a new EAD more than 120 days before your original EAD is set to expire.
If you have an EAD that has incorrect information on it, you will need to final for a replacement. If the card that Immigration Office issued to you has incorrect information that is not attributed to USCIS error, you will need to file a new I-765 and you will also be required to submit any documents specified, as well as filing fees. Additionally, you must submit the incorrect EAD card. If your card is incorrect because USCIS made an error, they will make the appropriate corrections. You will not be required to file a new form and you will not be required to repay the filing fees in this situation. You will still need to submit the original card that contains the errors, and you will also need to submit a detailed explanation of the errors that are contained on your EAD. You will also need to submit any supporting documentation that shows the correct information that should be on the EAD. If you have lost your work permit, or it has been stolen or destroyed, you may file a new I-765 and pay the filing fees to obtain a new one. |
